Orders and injunctions are, from the lay person<\/a>’s perspective, quite similar. Black’s Law<\/a> Dictionary provides the following (in part):<\/span><\/p>\n

Injunction<\/a>
\nA court order commanding or preventing an action<\/a>.<\/strong><\/span><\/p>\n

Order
\nA command, direction, or instruction. A written direction or command delivered by a court or judge<\/a>.<\/strong><\/span><\/p>\n

There are a great many different types of each but only a relative few that are seen by process servers. From the definitions it is deduced that an injunction<\/a> is actually a special type of order. The two are mentioned together because 7.40 RCW, entitled ‘Injunctions’, plays a major role in this topic.<\/span><\/p>\n

RCW 7.40.120
\nInjunction<\/a>, who is bound by.
\nAn order of injunction<\/a> shall bind every person<\/a> and officer restrained from the time he is informed thereof.<\/em><\/span><\/p>\n

RCW 7.40.150
\nContempt for disobedience.
\nWhenever it shall appear to any court granting a restraining order or an order of injunction<\/a>, or by affidavit<\/a>, that any person<\/a> has wilfully disobeyed the order after notice<\/a> thereof, such court shall award an attachment for contempt against the party<\/a> charged, or an order to show cause<\/a> why it should not issue. The attachment or order shall be issued by the clerk of the court, and directed to the sheriff, and shall be served by him.<\/em><\/span><\/p>\n

RCW 7.40.160
\nAttachment and arrest — Indemnity of plaintiff.
\nThe attachment for contempt shall be immediately served, by arresting the party<\/a> charged, and bringing him into court, if in session, to be dealt with as in other cases of contempt; and the court shall also take all necessary measures to secure and indemnify the plaintiff against damages<\/a> in the premises.<\/em><\/span><\/p>\n

From the process server’s point of view there are two categories of orders:<\/span><\/p>\n
