{"id":57,"date":"2018-01-13T15:40:39","date_gmt":"2018-01-13T07:40:39","guid":{"rendered":"http:\/\/trainingpips.com\/?page_id=57"},"modified":"2018-12-20T11:11:41","modified_gmt":"2018-12-20T19:11:41","slug":"ps-101-chapter-4-article-1-process-server-registration","status":"publish","type":"page","link":"https:\/\/www.trainingpips.com\/index.php\/ps-101-a-course-outline\/ps-101-chapter-4-chapter-outline-business-operations\/ps-101-chapter-4-article-1-process-server-registration\/","title":{"rendered":"PS 101 &#8211; Chapter 4 &#8211; Article 1 &#8211; Process Server Registration"},"content":{"rendered":"<p><a href=\"http:\/\/www.c4pse.com\/\">18.180 RCW<\/a> <span style=\"color: #000000;\">governs the registration of process servers.<\/span><\/p>\n<p><span style=\"color: #000000;\"><span id=\"_spanQT7120851452\">With certain exceptions, any <a class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"cmtt_905afd290a502cd9c24b5a34ce499744\" href=\"https:\/\/www.trainingpips.com\/index.php\/glossary\/person\/\" data-mobile-support=\"0\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">person<\/a> who serves <a class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"cmtt_c8c9f68e786e7fe18d701288574b91da\" href=\"https:\/\/www.trainingpips.com\/index.php\/glossary\/legal\/\" data-mobile-support=\"0\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">legal<\/a> process for a fee must register with the <a class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"cmtt_3fc9a160702d36ad8dfff3b08eac36c3\" href=\"https:\/\/www.trainingpips.com\/index.php\/glossary\/county\/\" data-mobile-support=\"0\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">county<\/a> auditor of the <a class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"cmtt_3fc9a160702d36ad8dfff3b08eac36c3\" href=\"https:\/\/www.trainingpips.com\/index.php\/glossary\/county\/\" data-mobile-support=\"0\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">county<\/a> in which he or she lives or in which he or she has a principal place of business.<\/span> Registration only needs to be done once and not in each <a class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"cmtt_3fc9a160702d36ad8dfff3b08eac36c3\" href=\"https:\/\/www.trainingpips.com\/index.php\/glossary\/county\/\" data-mobile-support=\"0\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">county<\/a> in which process is served.<\/span><\/p>\n<p><span style=\"color: #000000;\">The following are exempted from this requirement:<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">A sheriff, deputy sheriff, marshal, constable, or government employee who is acting in the course of employment;<\/span><\/li>\n<li><span style=\"color: #000000;\">An attorney or the attorney&#x2019;s employees, who are not serving process on a fee basis;<\/span><\/li>\n<li><span id=\"_spanQT3415655756\" style=\"color: #000000;\">A <a class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"cmtt_905afd290a502cd9c24b5a34ce499744\" href=\"https:\/\/www.trainingpips.com\/index.php\/glossary\/person\/\" data-mobile-support=\"0\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">person<\/a> who is court appointed to serve the court&#x2019;s process<\/span><\/li>\n<li><span style=\"color: #000000;\">A <a class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"cmtt_905afd290a502cd9c24b5a34ce499744\" href=\"https:\/\/www.trainingpips.com\/index.php\/glossary\/person\/\" data-mobile-support=\"0\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">person<\/a> who does not receive a fee or wage for serving process.<\/span><\/li>\n<li><span style=\"color: #000000;\">A licensed <a class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"cmtt_12275c888f489d9c88a5b76208940d97\" href=\"https:\/\/www.trainingpips.com\/index.php\/glossary\/private-investigator\/\" data-mobile-support=\"0\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">private investigator<\/a>.<\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">The registration is valid for one year and must be renewed on an annual basis. Renewal is also required when the server&#x2019;s <a class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"cmtt_ec91a4360498b21752ab183b70a6ca53\" href=\"https:\/\/www.trainingpips.com\/index.php\/glossary\/information\/\" data-mobile-support=\"0\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">information<\/a> (such as address, telephone number, etc) changes.<\/span><\/p>\n<p><span style=\"color: #000000;\"><span id=\"_spanQT3455619134\">Registration is required of anyone serving process for a fee. This includes employees of a registered process server.<\/span> Since in many companies any employee might need to perform a service, even if only rarely, it makes sense to register all employees.<\/span><\/p>\n<p><span style=\"color: #000000;\">The registration number assigned by the auditor must be shown on each Proof of Service signed by the server.<\/span><\/p>\n<p><span style=\"color: #000000;\">A <a class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"cmtt_cdad8f4671f8b195e0bbd57293fa5d08\" href=\"https:\/\/www.trainingpips.com\/index.php\/glossary\/party\/\" data-mobile-support=\"0\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">party<\/a> in a <a class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"cmtt_ee0906d5d691acc059558479e885ae08\" href=\"https:\/\/www.trainingpips.com\/index.php\/glossary\/case\/\" data-mobile-support=\"0\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">case<\/a> can only collect as costs the fee they paid for service if they use a registered process server or a server who is exempt from the registration requirements (see above). If a <a class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"cmtt_cdad8f4671f8b195e0bbd57293fa5d08\" href=\"https:\/\/www.trainingpips.com\/index.php\/glossary\/party\/\" data-mobile-support=\"0\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">party<\/a> uses a server who is not registered, but under 18.180 should be so registered, the <a class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"cmtt_cdad8f4671f8b195e0bbd57293fa5d08\" href=\"https:\/\/www.trainingpips.com\/index.php\/glossary\/party\/\" data-mobile-support=\"0\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">party<\/a> <a class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"cmtt_836e5f892f15e815cb6ad041454ae630\" href=\"https:\/\/www.trainingpips.com\/index.php\/glossary\/may\/\" data-mobile-support=\"0\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">may<\/a> still collect the service fee as costs if the process server registers within 45 days after serving the documents.<\/span><\/p>\n<p><span style=\"color: #000000;\"><span id=\"_spanQT2737102311\">The registration fee should be $10 and no more. Some <a class=\"glossaryLink\" aria-describedby=\"tt\" data-cmtooltip=\"cmtt_3fc9a160702d36ad8dfff3b08eac36c3\" href=\"https:\/\/www.trainingpips.com\/index.php\/glossary\/county\/\" data-mobile-support=\"0\" data-gt-translate-attributes='[{\"attribute\":\"data-cmtooltip\", \"format\":\"html\"}]' tabindex=\"0\" role=\"link\">county<\/a> auditors incorrectly add other fees to the registration fee.<\/span> Any fee above $10 should be protested.<\/span><\/p>\n<p><span style=\"color: #000000;\">Finally, in order to register as a process server, you must be a resident of Washington.&#xA0;<\/span><\/p>\n<p>[qsm quiz=23]<\/p>\n","protected":false},"excerpt":{"rendered":"<p>18.180 RCW governs the registration of process servers.
