RCW 4.28.080(4)<\/a>
\nIf against a railroad corporation<\/a>, to any station, freight, ticket or other agent<\/a> thereof within this state.<\/em><\/span><\/p>\n

In the past, when railroads were decentralized and less automated, an agent<\/a> could be found in almost every city and town where the railroad had a station. This is no longer the case<\/a>. Many stations, especially for railroads moving freight, no longer have agents assigned to them.<\/span><\/p>\n

The structure of these corporations has changed but this statute has not. Fortunately, the statute does allow for service via any “other agent<\/a> thereof” and railroads, as with most corporations, are required to maintain registered agents so service is generally straight forward by leaving the summons with the person<\/a> designated as such.<\/span><\/p>\n

Finally, there is a rather interesting distinction in this paragraph of the statute. There is a requirement that the service be presented to an agent<\/a> of the railroad within this state<\/strong>. The supreme court has enforced this rule to the dismay of a process server who happened to serve the documents across the state line in Idaho.<\/span><\/p>\n
