1.<\/strong><\/td>\nService of Process<\/strong><\/td>\n<\/tr>\n
<\/td>\n1.1<\/strong><\/td>\nRefuse to work with, work for, employ, or otherwise professionally associate with anyone who knowingly falsifies proofs of service, forges another’s signature, commits perjury<\/a>, or otherwise acts in a manner to bring discredit to professional process servers or harm to a client or to the public.<\/span><\/td>\n<\/tr>\n
<\/td>\n1.2<\/strong><\/td>\nProcess is served in accordance with applicable statutory law<\/a>, case<\/a> law<\/a>, rules of the court, or client instruction.<\/span><\/td>\n<\/tr>\n
<\/td>\n1.3<\/strong><\/td>\nFull cooperation is provided to the court system whenever a claim<\/a> of defective service is made.<\/td>\n<\/tr>\n
<\/td>\n1.4<\/strong><\/td>\nFull cooperation is provided to the client whenever a claim<\/a> of defective service is made.<\/span><\/td>\n<\/tr>\n
<\/td>\n1.5<\/strong><\/td>\nCooperation with opposing counsel or third parties is provided only upon receipt of written permission from client.<\/span><\/td>\n<\/tr>\n
<\/td>\n1.6<\/strong><\/td>\nAll work done for a client is confidential in nature. This confidentiality outlasts the completion of any particular assignment.<\/span><\/td>\n<\/tr>\n
<\/td>\n1.7<\/strong><\/td>\nService of process is made by a disinterested third party<\/a>.<\/span><\/td>\n<\/tr>\n
<\/td>\n1.8<\/strong><\/td>\nPersonal “in hand” service is the preferred method of service.<\/td>\n<\/tr>\n
<\/td>\n1.9<\/strong><\/td>\nAbode service, also known as substitute service, is acceptable when done in accordance with statutory law<\/a>, case<\/a> law<\/a>, court rule<\/a>, or client instruction.<\/td>\n<\/tr>\n
<\/td>\n1.10<\/strong><\/td>\nService is effected by pre<\/span>sentation of the documents in a manner that a reasonable<\/a> person<\/a> would understand they are being served with process.<\/span><\/td>\n<\/tr>\n
<\/td>\n1.11<\/strong><\/td>\nWhenever reasonably possible, the person<\/a> who receives the documents is asked to sign their name acknowledging such receipt.<\/span> This signature becomes a part of the service record. If the person<\/a> refuses to sign acknowledging receipt of the document, the process server notes such refusal in the record of service.<\/td>\n<\/tr>\n
<\/td>\n1.12<\/strong><\/td>\nWhere the documents cannot be served personally or via abode service, all attempts are documented in a manner reasonably calculated to allow the client to use an alternative method of service.<\/span><\/td>\n<\/tr>\n
<\/td>\n1.13<\/strong><\/td>\nService on persons “in law<\/a>”, such as corporations and government entities, is made in accordance with statutory law<\/a>, case<\/a> law<\/a>, court rule<\/a>, or client instruction.<\/td>\n<\/tr>\n
<\/td>\n1.14<\/strong><\/td>\nService of process is made in accordance with client instructions so long as such instructions are moral, ethical, and do not result in a violation of criminal law<\/a>.<\/span><\/td>\n<\/tr>\n
<\/td>\n1.15<\/strong><\/td>\nIn descending order of acceptability, service on persons is obtained as follows:<\/td>\n<\/tr>\n
<\/td>\n<\/td>\nA.<\/strong><\/td>\nPersonal “in hand” service.<\/td>\n<\/tr>\n
<\/td>\n<\/td>\nB.<\/strong><\/td>\nAbode service.<\/td>\n<\/tr>\n
<\/td>\n<\/td>\nC.<\/strong><\/td>\nSpecial situations where diligence<\/a> is required such as:<\/td>\n<\/tr>\n
<\/td>\n<\/td>\n<\/td>\na.<\/strong><\/td>\nPublication<\/td>\n<\/tr>\n
<\/td>\n<\/td>\n<\/td>\nb.<\/strong><\/td>\nMailing<\/td>\n<\/tr>\n
<\/td>\n<\/td>\n<\/td>\nc.<\/strong><\/td>\nSecretary of State<\/td>\n<\/tr>\n
<\/td>\n<\/td>\n<\/td>\nd.<\/strong><\/td>\nElectronic<\/td>\n<\/tr>\n
<\/td>\n<\/td>\nD.<\/strong><\/td>\nIn accordance with client instructions<\/td>\n<\/tr>\n
